We have the right to revise and amend these Terms and Conditions from time to time to reflect changes in market conditions affecting Our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in Our system’s capabilities or for any other reason in Our sole reasonable discretion which We may decide. You agree that Romègas shall not be liable to You or to any third party for any such modification, suspension or discontinuance of the use of the Website or any of its respective facilities.

The applicable (and possibly additional) terms and conditions, including applicable rates, shall be communicated at the time of booking, whether on Our Website or any third-party channel or website (such as booking websites) and shall form part of the reservation terms. You should read all applicable terms and conditions (including third-party terms and conditions) prior to making any booking or reservation for services to be provided by Us.

where Guest behaviour is deemed unlawful, abusive, threatening, disruptive, intoxicated, or damaging to property or reputation.

For the avoidance of doubt, We may also cancel or refuse a reservation where payment, identity, or card details cannot be verified, fraud or misuse is suspected, a pricing or availability error has occurred, legal restrictions apply, or the Guest is in material breach of these Terms and Conditions, subject always to mandatory consumer rights.

Guests must comply with applicable Maltese law, lawful instructions, licensing requirements, Hotel policies, and reasonable staff directions.

Hazardous, illegal, disruptive, or unauthorised items are prohibited, including candles, incense, cooking appliances, explosives, weapons, illegal substances, drones, and items likely to endanger persons or property.

Guests are responsible for safeguarding their personal belongings.

Romègas shall not be liable for loss, theft, or damage to cash, jewellery, valuables, electronics, documents, vehicles, or personal effects except where liability cannot legally be excluded under Maltese law, including but not limited to liability arising under the Civil Code (Cap. 16 of the Laws of Malta) and any applicable subsidiary legislation governing innkeeper liability.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by Romègas’ gross negligence or wilful misconduct, fraud, or any other liability which cannot lawfully be excluded or limited under Maltese law, subject always to all mandatory consumer rights You may enjoy.

Service animals recognised under applicable law shall be accommodated in accordance with legal requirements.

13. FOOD & BEVERAGE

Restaurant, bar, rooftop bar, poolside, in-room dining, and other food and beverage services are subject to operating schedules, seasonal availability, requirements of third-party operators or suppliers, weather conditions, private events, licensing requirements, and operational considerations.

Certain venues, including the rooftop bar and outdoor areas, may operate on a seasonal basis and may be temporarily closed, restricted, or reserved without prior notice.

Opening hours, menus, entertainment, concepts, and service offerings may change at the discretion of the relevant venue.

We reserve the right to restrict the consumption of externally sourced food and beverages within guest rooms, restaurants, lounges, terraces, rooftop areas, and other public spaces.

Guests are required to inform Romègas in writing, or by email, or through any indicated form (digital or otherwise) of any food allergies, intolerances, or dietary restrictions at the time of booking or, at the latest, upon check-in. We shall use reasonable endeavours to accommodate disclosed requirements; however, Romègas cannot guarantee an allergen-free environment at the Hotel and shall not be liable for any allergic reaction or adverse health consequence arising from undisclosed allergies, cross-contamination, or ingredients present in any meals prepared on the premises or by third-party suppliers.

We accept no liability for any services, treatments, availability, injuries, health issues, losses, or experiences relating to any third-party bar or restaurant operating within or outside the Hotel.

14. WELLNESS, SPA & FITNESS FACILITIES

Romègas Hotel features a rooftop pool for the exclusive use of registered Hotel Guests, subject to operational hours, weather conditions, maintenance requirements, and health and safety regulations.

The Hotel does not currently operate an on-site spa or gymnasium.

We may recommend independent wellness or fitness facilities located in the surrounding area; however, such facilities are operated entirely by third parties and remain independent from Romègas and/or the Hotel.

We accept no liability for services, treatments, availability, injuries, losses, or experiences relating to any third-party facilities.

15. EVENTS, PHOTOGRAPHY & COMMERCIAL USE

Professional photography, filming, commercial activities, events, or media production on Hotel premises require Our express prior written approval.

We reserve the right to restrict unauthorised commercial or disruptive activity.

16. INTERNET ACCESS

Complimentary Wi-Fi may be provided at the Hotel subject to availability and subject to the terms of Our Privacy Policy.

Romègas does not guarantee uninterrupted or secure Internet access and shall not be liable for network interruptions, data loss, or cybersecurity issues.

Guests agree not to use Our Hotel Internet services for unlawful, abusive, or harmful purposes.

17. PARKING & TRANSPORTATION

Romègas Hotel does not offer on-site parking facilities.

Limited public parking may be available within the surrounding residential area, subject to local regulations and availability.

Valet parking services, where arranged, are provided at an additional charge and vehicles may be parked at off-site locations situated away from the Hotel premises.

We accept no liability for theft, damage, delays, accidents, fines, or loss involving vehicles or belongings left therein.

18. LOST & FOUND

Items found at the Hotel or any of Our premises may be retained for a limited period determined by Us. Where requested, found items may be returned at the Guest’s expense and risk, where applicable. Perishable, intimate, or hazardous items may be discarded without notice. Items containing personal data will be processed only as necessary and this in accordance with Our Privacy Policy.

19. PRIVACY & DATA PROTECTION

Romègas, as data controller, processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the Data Protection Act (Cap. 586 of the Laws of Malta), and any subsidiary legislation enacted thereunder and in accordance with Our Privacy Policy which You hereby declare to have read and understood.

Other entities, including without limitation, third-party restaurants operating within Our premises, including the Hotel, are to be considered as separate data controllers and their respective privacy policies should be read and understood accordingly as applicable.

CCTV and other security monitoring may be used in public and staff areas of the Hotel for safety, security, incident management, and legal compliance purposes, as further described in Our Privacy Policy and applicable notices.

20. HEALTH & SAFETY

Guests must comply with all health, safety, fire, and emergency procedures communicated by Romègas and/or any Hotel staff, including evacuation plans displayed within Our premises.

Guests using the rooftop pool do so at their own risk and must observe all posted and general safety rules. The pool is unsupervised and children under the age of twelve (12) must be accompanied by a responsible adult at all times in the pool area.

We reserve the right to evacuate or restrict access to certain areas in emergency situations.

For the avoidance of doubt, facilities, services, areas, and amenities may be temporarily unavailable, restricted, or modified for maintenance, safety, weather, private events, operational reasons, or legal requirements.

21. BUILDING CHARACTERISTICS, HERITAGE FEATURES & ASSUMPTION OF RISK

The Guest acknowledges and accepts that the Hotel is housed within a converted older building located in Valletta, Malta, forming part of the historic urban fabric of the city. By its nature, and notwithstanding any refurbishment, adaptation, maintenance, or safety measures implemented by Romègas, the building may retain or include structural, architectural, spatial, and design characteristics commonly associated with older and heritage properties in Valletta and similar historic locations.

Such characteristics may include, without limitation, low ceilings, narrow passageways and corridors, restricted turning spaces, changes in floor level, steps, thresholds, uneven or traditional flooring surfaces, limited headroom, compact staircases, confined access routes, traditional stonework, historic architectural features, and other physical limitations or features which may differ from those ordinarily found in modern purpose-built hotels.

The Guest further acknowledges that such features are part of the character, setting, and experience of the Hotel, but that they may also give rise to certain inherent risks, including risks of slips, trips, falls, accidental impact, restricted movement, discomfort, or difficulty of access for persons with mobility and/or other similar limitations, visual impairments, medical conditions, or other personal circumstances which may affect their ability to safely navigate the premises.

Without prejudice to Romègas’ health and safety obligations, by entering the Hotel, checking in, staying at the Hotel, using any part of the Hotel premises, or otherwise receiving any of Romègas’ services, the Guest confirms that they have been made aware of, have understood, and accept the above risks and characteristics. For the avoidance of doubt, nothing in this clause shall be construed as excluding Our liability for manifestly unsafe maintenance, failure to warn of known hazards or any of Our statutory obligations.

The Guest agrees to exercise due care and attention when moving through and using the Hotel premises and shall comply with all reasonable safety instructions, signage, notices, and directions issued by Romègas or its staff.

To the fullest extent permitted by Maltese law, Romègas and its owners, directors, officers, employees, and agents shall not be liable for any injury, loss, damage, claim, cost, or expense, whether direct, indirect, incidental, consequential or otherwise, arising from or connected to the inherent structural, architectural, spatial, or heritage characteristics of the building, including but not limited to falls, trips, slips, impacts and/or any other incident attributable to the inherent features described above except where such liability cannot lawfully be excluded or limited, including in cases of death or personal injury caused by Romègas’ gross negligence or wilful misconduct.

22. ACCESSIBILITY

Subject to the Hotel limitations as explained in Clause 21 above, Romègas aims to accommodate Guests with accessibility requirements wherever reasonably practicable.

Guests are encouraged to notify Us of any specific requirements that the Guests reasonably consider relevant to be able to receive the requested assistance, prior to arrival at the Hotel, in writing, via email and/or via any other indicated manner (digitally or otherwise). Such disclosures are voluntary except where necessary for a specific requested service or accommodation.

Any such disclosed information amounting to health data shall be processed as necessary by Romègas in accordance with Our Privacy Policy, the GDPR, and applicable data protection legislation.

23. GUEST HEALTH & PRE-EXISTING CONDITIONS

23.1 Disclosure Obligation

Where relevant and necessary for the purpose stated in Clause 23.2 hereunder, Guests are requested to disclose to Romègas, prior to arrival or at the latest upon check-in, any pre-existing medical conditions, physical disabilities, mobility impairments, allergies (whether food-related, environmental, or otherwise), chronic illnesses, or other health-related matters that may be relevant to the Guest’s safety, comfort, or ability to navigate and use the Hotel premises and facilities.

23.2 Purpose of Disclosure

Such disclosures are requested solely for the purpose of enabling Us to take reasonable steps to accommodate the Guest’s needs and to assess whether the Hotel premises and facilities are suitable for the Guest’s requirements. All health-related information provided shall be treated as special category personal data and processed in accordance with Our Privacy Policy, the GDPR, and applicable data protection legislation.

23.3 Limitation of Liability — Undisclosed Conditions

Where a Guest fails to disclose a relevant pre-existing condition, Romègas shall not be liable for any injury, loss, harm, aggravation of condition, or adverse health outcome arising from or connected to the undisclosed condition, to the fullest extent permissible under Maltese law. Romègas’ duty of care shall be assessed by reference to the information reasonably available to it at the relevant time.

24. CHILDREN & MINORS

Children under the age of twelve (12) must be accompanied and supervised by a responsible adult at all times whilst on the Hotel premises, including in guest rooms, corridors, staircases, the rooftop pool area, and all common areas.

Romègas accepts no liability for injury or harm sustained by unsupervised minors.

Certain Hotel facilities, services, and experiences may be restricted to Guests aged eighteen (18) and over.

25. GUEST INDEMNIFICATION & INSURANCE

25.1 Indemnification

The Guest agrees to indemnify, defend, and hold harmless Romègas, its owners, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  1. the Guest’s breach of these Terms and Conditions;
  2. the Guest’s negligent or wilful acts or omissions whilst on the Hotel premises;
  3. damage caused by the Guest or the Guest’s visitors, minors under their care, pets, or invitees to the Hotel or any Romègas property or to third parties; or
  4. any misrepresentation or failure to disclose information required under these Terms and Conditions or at law.

25.2 Travel & Health Insurance

Guests are strongly recommended to obtain comprehensive travel and health insurance covering the full duration of their stay, including cover for medical emergencies, personal injury, cancellation, loss of personal property, and repatriation. Romègas shall not be responsible for uninsured losses except to the extent that such losses arise from liability which cannot lawfully be excluded or limited under applicable law. The recommendation to obtain insurance does not affect any mandatory rights or remedies which the Guest may have under applicable law.

26. COMPLAINTS & ALTERNATIVE DISPUTE RESOLUTION

Guests who wish to raise a complaint are encouraged to do so during their stay so that Romègas may endeavour to resolve the matter promptly. Complaints may also be submitted in writing to hello@romegashotel.com within the applicable statutory periods.

Alternatively, You may refer the dispute to an Alternative Dispute Resolution (ADR) entity. In Malta, the Complaints and Conciliation Directorate within the Malta Competition and Consumer Affairs Authority (MCCAA) acts as a residual ADR body for consumer disputes. More information is available at: https://adr.mccaa.org.mt.

Please note that the European Commission lists alternative dispute resolution (ADR) bodies in the EU and the EEA through its website (https://consumer-redress.ec.europa.eu/list-alternative-dispute-resolution-adr-bodies_en?page=30) which is dedicated to helping consumers and traders resolve their disputes out-of-court, including cross-border disputes.

27. RIGHT TO REFUSE SERVICE

For the avoidance of all doubt and without prejudice to anything else stipulated in these Terms and Conditions, including Clause 7 above, Romègas reserves the right to refuse accommodation or entry to the Hotel or any other Romègas service where:

  • Required by law;
  • Payment or identification cannot be verified;
  • Guest behaviour is deemed inappropriate;
  • Occupancy limits are exceeded; or
  • Safety, security, or operational concerns arise.

28. GOVERNING LAW & JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malta.

Any dispute arising in connection with these Terms and Conditions or any stay at the Hotel shall be subject to the exclusive jurisdiction of the Maltese courts.

This clause shall not affect any mandatory rights which a Guest may have as a consumer to bring proceedings in another competent jurisdiction.

29. ADDITIONAL TERMS FOR SUITES, PRIVATE EXPERIENCES & BESPOKE SERVICES

Certain suites, private dining experiences, butler services, transfers, yacht charters, excursions, wellness programmes, or bespoke experiences may be subject to supplementary terms, deposits, cancellation policies, and operational limitations.

Such terms shall be communicated at the time of booking or confirmation.

30. INTELLECTUAL PROPERTY

All trademarks, branding, photography, artwork, design elements, text, and content associated with Romègas and/or the Hotel shall remain the intellectual property of Romègas or its licensors.

No material may be reproduced or commercially used without Our express prior written consent.

Romègas’ Website is subject to additional copyright terms and conditions which are available on Our Website.

31. WEBSITE TERMS

Romègas does not guarantee that its Website shall be uninterrupted, error-free, or free from harmful components.

Content, imagery, renderings, descriptions, layouts, and visual representations displayed on the Website, marketing materials, social media platforms, or promotional collateral may be provided for illustrative purposes only.

During the pre-opening and transitional period and/or any future renovation or upgrade periods, certain images used by Romègas (in connection with the Hotel or otherwise) may consist of architectural renderings, CGI visualisations, design concepts, or artist impressions intended to represent the planned aesthetic, atmosphere, and design direction of the Hotel premises.

While Romègas shall use reasonable efforts to ensure accuracy and consistency, final delivered rooms, suites, facilities, furnishings, finishes, views, layouts, amenities, and operational services may differ from such representations.

We reserve the right to modify, replace, update, or alter any content, specifications, imagery, services, or operational details without prior notice.

Romègas further reserves the right to correct pricing errors, inaccuracies, or omissions at any time.

For the avoidance of doubt, nothing in this clause shall be construed as permitting Romègas to materially misdescribe the accommodation or deprive Guests of the essential characteristics of the booking or reservation confirmed to them.

32. CONSUMER RIGHTS

Nothing in these Terms and Conditions shall exclude, restrict or prejudice any mandatory rights or remedies which a Guest may have as a consumer under applicable Maltese or EU consumer protection law, nor shall anything in these Terms and Conditions exclude or limit any liability which cannot lawfully be excluded or limited.

33. ENTIRE AGREEMENT

These Terms and Conditions, together with any booking confirmation, Privacy Policy, Cookie Policy, Copyright Notice and applicable supplementary policies, constitute the entire agreement between the Guest and Romègas.

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

We may communicate with Guests by email, telephone, SMS, messaging platform, booking platform, or other electronic means using the contact details provided at or after booking.

If these Terms and Conditions are translated, the English version shall prevail to the extent of any inconsistency, unless otherwise required by mandatory law.
